ICE agents arrest two men in Encinitas
ENCINITAS, Calif. (FOX 5/KUSI) -- U.S. Immigration and Customs Enforcement (ICE) agents arrested two men in Encinitas on Friday morning.
Yohan Diaz and Limber Hernandez were taken into custody by immigration agents, according to a statement made by ICE San Diego Field Office Director Patrick Divver.
State Senator Catherine Blakespear, who represents the Encinitas area, said video of the arrest shows agents handling them brutally.
“ICE made another arrest in Encinitas today, and a bystander’s video shows this arrest being carried out with extreme force and brutality,” Blakespear said.
Divver’s statement alleges that Diaz has a criminal record of “child cruelty, assault with a deadly weapon, battery on a peace officer, obstruction of a public officer, vandalism, and DUI.”
“ICE San Diego remains committed to enforcing federal immigration law while ensuring the safety of the community and our officers,” Divver said.
Both individuals are currently in ICE custody pending deportation proceedings, according to the statement.
This arrest comes two days after ICE arrested a parent near Park Dale Lane Elementary in Encinitas. This prompted Encinitas City Council to discuss emergency responses in their council meeting on Wednesday. Possible items for council discussion include:
- Exploring how to establish safe zones
- Exploring joining lawsuits challenging ICE operations
- Submitting a Freedom of Information Act to document ICE operations in Encinitas
- Forming a community communications group (text chain)
- Sending letters to federal agencies protesting actions
- Requesting federal partners to be present to respond to questions from city and community
- Investigating ability to limit mask wearing by ICE
- Exploring other legal mechanisms available to the city
“These types of arrests are inhumane and traumatize all involved and the communities in which they happen,” Blakespear said. “I am outraged, and I encourage everyone who is also outraged to speak up, contact their members of Congress and demand that this stop.”
