Apartment challenges Crestwood decision to vacate building

ST. LOUIS COUNTY, Mo. - The owners of an apartment complex that have been under recent scrutiny for "life safety" issues are filing a lawsuit against the City of Crestwood for its attempt to vacate the complex.

Last week, a judge ordered residents of a building in Forestview Apartments to vacate their unit by Sept. 10 due to code violation issues the city discovered that go back to last September, according to prior FOX 2 reports.

The apartment complex formally filed a lawsuit on Aug. 29 against the City of Crestwood. According to court documents, their buildings were inspected twice in between receiving their first dangerous building notice in late April to late June.

Their lawsuit claims the the decision should be overturned due to a lack of substantial evidence, being against the overwhelming weight of evidence, and claiming that the city building commissioner and deputy city administrator "abused their discretion."

The judge made the decision forcing residents to leave due to structural and electrical concerns among other problems.

As of last week, the city said Forestview had approved permits for some critical work on the building, but some of those permits have been sitting for more than a month to be picked up. Other permits, related to unsafe balconies, have not been collected in over a year.

The order applies to one out of 11 buildings at the complex. However, the rest of the buildings are also in jeopardy of the same fate if repairs aren't made by Oct. 21.

Forestview Apartments is asking the court to reverse and vacate the city's decision.

FOX 2 reached out to Forestview Apartments and the City of Crestwood for comment, but has not received an immediate response.
